Section 28 of the WSH Officer, 2009 indicates that every workplace within the prescribed class or description of workplaces shall have a WSH Officer or a WSH Co-ordinator appointed in respect hereof.

The requirement of the appointment of WSH Officer is also regulated by the Workplace Safety and Health (Workplace Safety and Health Officers) Regulations, 2014. Under these regulations, a WSH Officer shall be appointed in:

- Shipyards in which any ship, tanker and other vessels are constructed, reconstructed, repaired, refitted, finished or broken up;
- Factories used for processing petroleum or petroleum products;
-Factories in which building operations or works of engineering construction (BOWEC) of a contract sum of $10 million or more are carried out;
- Any other factories as below where 100 or more persons are employed, except those which are used for manufacturing garments.

Building operations or work of engineering construction (BOWEC) here refers to any building operations and works of engineering construction undertaken by way of trade or business, or for the purpose of any industrial or commercial undertaking (i.e., Building construction activities), or by or on behalf of the Government or any statutory authority and to any line or siding which is used in connection therewith and for the purposes thereof.

Section 32 of Workplace Safety and Health Order, 200 indicate that no person shall act as WSH Officer except with the approval of the authority (SHENA)

Please refer to Regulation 8 (3) of the Workplace Safety and Health (Workplace Safety and Health Officers) Regulations 2014. If your workplace is within the prescribed class or description of workplaces specified in the Second Schedule and does not appoint a Workplace Safety and Health Officer, the occupier shall be guilty of an offence and liable on conviction to a fine not exceeding $10,000 and, in the case of a continuing offence, to a further fine not exceeding $1,000 for every day or part thereof during which the offence continues after conviction.

or other relevant qualification in the authority's opinion that enables the individual to act as WSH Officer

To be appointed as a WSH Officer, an individual need to have at least two (2) years practical experience relevant to the work to be performed that demonstrates his/ her roles and responsibilities in workplace safety and health. The expectation from SHENA is for the individual to be actively involved with the workplace.

This is subject to the assessment review as there are other criteria that will take into consideration as well i.e training attended related to HSE, experience in related to HSE and etc. The person will be called in an interview with SHENA for further clarification on his exposure as well as experience and knowledge to act as WSH Officer/Co-ordinator

Under the Workplace Safety and Health (Workplace Safety and Health Officers) Regulations 2014, it is the duty of the occupier to appoint WSH Officer for their company. Once u leave the company, you are no longer responsible for the workplace safety and health issues pertaining to that company and the company will have to submit an application for a new individual to be appointed to the role.

The company should inform SHENA as soon as reasonably practicable of the resignation with a letter of de-registration of the individual to act as WSH Officer signed by the employer. This letter should be sent to WSH Officer email wshofficer@shena.gov.bn. SHENA will immediately deactivate the registration.

The Safety Case shall reflect that the duty holder has ensured that the development of the document is through effective consultation with the workforce and participation of the workplace safety and health officer for that facility.

For Combined Operations Safety Case:
The combined operations Safety Case shall reflect that all the duty holders have ensured that the development of the document is through effective consultation with the workforce and participation of the workplace safety and health officer of each of the facility involved.

Yes, as per Section 35 (1), Workplace Safety and Health Order, 2009, the authority can cancel and suspend the application under the following condition:

- Person had obtained or procured his approval by fraud or misrepresentation; or
- Person in breach of any condition subject to which the approval was granted; or
- Person is no longer fit and proper person to act as a relevant WSH Officer; or
- It is in the public interest to do so

- A copy of police report of the card missing
- Copy of NRIC (both side) or Passport (Frontpage, visa page and last page)
- Transmittal of collection for Certificate of approval (when he/she obtained the card from SHENA

​​Under the Radiation Protection Order, 2018, a "radioactive material" means any material containing a radioactive substance giving it a specific or total radioactivity greater than 70 becquerels per gram (70 Bq/g) (0.002 u(i/g) or 70 kBq/kg.

Under the Radiation Protection Order, 2018, a controlled apparatus is:

1. an apparatus that produces ionising radiation when energised or that would, if assembled or repaired, be capable of producing ionising radiation when energised;
2. an apparatus that produces ionising radiation because it contains radioactive material; and
3. an apparatus prescribed by regulations made under this Order that produces harmful non-ionising radiation when energised.

The radiation activities that require to be licensed are as follows:

1. Import and export of radioactive material and/or controlled apparatus;
2. Use or deal (including storage and disposal) with radioactive material and/or controlled apparatus;
3. Manufacture of radioactive material and/or controlled apparatus;
4. Transport of radioactive material; and
5. Sale of radioactive material and/or controlled apparatus.

Your company will need to be licensed with the Radiation Department, SHENA before you bring any radioactive material or controlled apparatus into Brunei Darussalam. Once licensed, you are required to submit an online permit application ( www.bdnsw.gov.bn) to the Brunei Darussalam National Single Window (BDNSW) through the Royal Customs and Excise Department (RCED).
